What to Do When a Loved One Passes Away Without a Will: Letter of Administration & Distribution Order
Losing a loved one is never easy, and the process could feel even more overwhelming if they passed away without leaving a Will. In legal terms, this is known as dying intestate. When this happens, family members cannot simply take over or manage the deceased’s estate. Instead, it is necessary to apply to the High Court for a Letter of Administration and a Distribution Order—legal documents that grant authority to administer and distribute the estate in accordance with the Distribution Act 1958.
At our law firm, we understand the emotional and legal challenges this situation brings. We are here to assist and guide you every step of the way.

Once the application is allowed, we will follow up with the High Court to obtain the sealed Letter of Administration. We will also assist in certifying the Letter of Administration and required document for use in distributing the deceased’s movable assets (such as monies in bank account and cars) in accordance with the law.
Application for Distribution Order
A Distribution Order is required for distributing the immovable properties of the deceased (e.g. land or houses) among the rightful beneficiaries, once the Letter of Administration has been obtained.
Our services include:
- Reviewing the Estate Details
We will identify the immovable properties, gather the necessary documents from you and determine each beneficiary’s entitlement under the law. - Preparing Cause Papers
